Tas nozīmē, ka procesam ir stingri juridiskie un tehniskie rāmji.</p><p data-path-to-node="1">Šeit būs detalizēts ceļvedis, kā pareizi sagatavot un iesniegt elektroniskos pierādījumus civillietā, balstoties uz Latvijas Republikas normatīvajiem aktiem.</p><p data-path-to-node="1" class="moze-center"><br><a class="moze-button-large" href="https://calendar.app.google/9hKHsCGNLSE5MZn8A" target="_blank">Pieteikties konsultācijai</a><br><br></p><h2 data-path-to-node="3">1. Juridiskais pamats: Kas ir elektroniskais pierādījums?</h2><p data-path-to-node="4"><a href="https://m.likumi.lv/ta/id/50500-civilprocesa-likums" target="_self">Civilprocesa likums (CPL)</a> neparedz atsevišķu nodaļu "elektroniskie pierādījumi". Civilprocesa likuma </p><p class="TV213 TVP moze-justify" id="p110" style="font-weight: 400; font-style: normal;"><b>110.pants definē rakstveida pierādījumus:&nbsp;</b><span style="font-style: normal; font-weight: 400;">Rakstveida pierādījumi ir ziņas par faktiem, kuriem ir nozīme lietā, un šīs ziņas ar burtu, ciparu un citu rakstisku zīmju vai tehnisku līdzekļu palīdzību ierakstītas dokumentos, citos rakstos, kā arī attiecīgās ierakstu sistēmās (audio, video magnetofonu lentēs, datoru disketēs u.c.).</span></p>Elektroniskie dati tiek klasificēti pēc to rakstura:<p></p><ul data-path-to-node="5"><li><p data-path-to-node="5,0,0"><b data-path-to-node="5,0,0" data-index-in-node="0">Rakstveida pierādījumi (CPL 110. pants) ir ziņas par faktiem, kuriem ir nozīme lietā:</b> E-pasti, tērzēšanas telpu sarakstes (WhatsApp, Telegram), digitālie līgumi, bankas maksājumu uzdevumi un interneta vietņu ekrānuzņēmumi (<i data-path-to-node="5,0,0" data-index-in-node="178">screenshots</i>).</p></li><li><p data-path-to-node="5,1,0"><b data-path-to-node="5,1,0" data-index-in-node="0">Audio, video un citi datu ieraksti :</b> Drošības kameru video, balss ziņas, telefonsarunu ieraksti, digitālās kartes un metadata.</p></li></ul><p><font color="#66717f">Saskaņā ar Civilprocesa likuma 112.pantā noteikto Tiesa pēc puses lūguma vai pēc savas iniciatīvas (ģimenes strīdos, piemēram), var pati izprasīt pierādījumus vai uzlikt par pienākumu pusei tos iesniegt.</font></p><blockquote data-path-to-node="6"><p data-path-to-node="6,0"><b data-path-to-node="6,0" data-index-in-node="0">Svarīgi (CPL 93. pants):</b> Katrai pusei ir jāpierāda tie fakti, uz kuriem tā pamato savus prasījumus vai iebildumus. Tiesā tiek pieņemti tikai tādi pierādījumi, kas ir <b data-path-to-node="6,0" data-index-in-node="167">attiecināmi</b>&nbsp;un <b data-path-to-node="6,0" data-index-in-node="236">pieļaujami.&nbsp;</b></p><p data-path-to-node="6,0">Civilprocesa likuma 114. pantā ir paredzēta iespēja tiesai apskatīt un izpētīt pierādījumus to atrašanās vietā.&nbsp;&nbsp;</p></blockquote><h2 data-path-to-node="8">2. Elektronisko pierādījumu noformēšana</h2><p data-path-to-node="9">Lai digitāls fails tiesā gūtu juridisku spēku, tam jābūt pareizi noformētam. Pašrocīgi modificēti faili vai vienkārši Word dokumentā iekopēts teksts tiesā nederēs.</p><h3 data-path-to-node="10">A. E-pasti un tērzēšanas (WhatsApp, Telegram u.c.) sarakstes</h3><p data-path-to-node="11">Augstākās tiesas Senāta prakse (piemēram, lietā Nr. SKC-555/2023) apstiprina, ka sarakste lietotnēs var kalpot kā pierādījums darījuma pušu gribas izteikumam.</p><ul data-path-to-node="12"><li><p data-path-to-node="12,0,0"><b data-path-to-node="12,0,0" data-index-in-node="0">Kā noformēt:</b> Neveidojiet vienkārši ekrānuzņēmumu ar atrautu teksta burbuli. Sarakste jāeksportē pilnībā (piemēram, PDF formātā) vai jāveido ekrānuzņēmumi, kuros ir skaidri redzams <b data-path-to-node="12,0,0" data-index-in-node="180">datums, laiks, sūtītāja un saņēmēja identitāte</b> (tālruņa numurs, e-pasta adrese vai verificēts profils).</p></li><li><p data-path-to-node="12,1,0"><b data-path-to-node="12,1,0" data-index-in-node="0">Tulkojums (CPL 13. pants):</b> Ja sarakste ir svešvalodā (piemēram, krievu vai angļu), obligāti jāpievieno normatīvajos aktos noteiktā kārtībā apliecināts tulkojums valsts valodā.</p></li></ul><h3 data-path-to-node="13">B. Digitāli parakstīti dokumenti</h3><ul data-path-to-node="14"><li><p data-path-to-node="14,0,0">Ja līgums vai akts ir parakstīts ar drošu elektronisko parakstu (<code data-path-to-node="14,0,0" data-index-in-node="65" style="font-weight: normal; font-style: normal">.edoc</code> vai <code data-path-to-node="14,0,0" data-index-in-node="75" style="font-weight: normal; font-style: normal">.asice</code> formātā), tas ir uzskatāms par rakstveida pierādījuma oriģinālu saskaņā ar<a href="https://likumi.lv/ta/id/68521-elektronisko-dokumentu-likums" target="_blank"> Elektronisko dokumentu likuma 3. pantu.</a></p></li><li><p data-path-to-node="14,1,0"><b data-path-to-node="14,1,0" data-index-in-node="0">Kā noformēt:</b> Šādi faili tiesā jāiesniedz to oriģinālajā struktūrā, tos nemainot un nekonvertējot.</p></li></ul><h3 data-path-to-node="15">C. Audio un video ieraksti</h3><ul data-path-to-node="16"><li><p data-path-to-node="16,0,0"><b data-path-to-node="16,0,0" data-index-in-node="0">Kā noformēt:</b> Saskaņā ar Civilprocesa likuma tiesu prakses atziņām, ja audio/video ierakstu ir iespējams iesniegt noraksta veidā, tas ir jādara (<b data-path-to-node="16,0,0" data-index-in-node="128">sarunas atšifrējums teksta formātā</b>).</p></li><li><p data-path-to-node="16,1,0">Pieteikumā tiesai jānorāda, kuras tieši minūtes/sekundes ierakstā ir būtiskas lietai un ko tās pierāda.</p></li></ul><h3 data-path-to-node="17">D. Kopiju apliecināšana (ja elektroniski iesniedz papīra dokumentu)</h3><ul data-path-to-node="18"><li><p data-path-to-node="18,0,0">Ja skenējat papīra dokumentu, lai to iesniegtu elektroniski, tam jābūt apliecinātam saskaņā ar <a href="https://likumi.lv/ta/id/301436-dokumentu-izstradasanas-un-noformesanas-kartiba" target="_blank">MK noteikumiem Nr. 558 "Dokumentu izstrādāšanas un noformēšanas kārtība"</a>. Uz dokumenta jābūt apliecinājuma uzrakstam ("KOPIJA PAREIZA", paraksts, atšifrējums, datums) vai arī visai pakotnei jābūt parakstītai ar iesniedzēja e-parakstu, apliecinot kopiju patiesumu.</p></li></ul><h2 data-path-to-node="20">3. Autorizācija notiek ar Latvija.lv rīkiem (eParaksts mobile, Smart-ID, eID karte).</p></li><li><p data-path-to-node="22,1,0"><b data-path-to-node="22,1,0" data-index-in-node="0">Alternatīvais kanāls – E-adrese vai E-pasts:</b> Ja tehnisku iemeslu dēļ portāls nedarbojas, dokumentus, kas parakstīti ar drošu elektronisko parakstu (eParaksts), var sūtīt uz tiesas oficiālo e-adresi vai tiesas e-pasta adresi.</p></li><li><p data-path-to-node="22,2,0"><b data-path-to-node="22,2,0" data-index-in-node="0">Tehniskie ierobežojumi:</b> Failu izmēriem ir limiti (parasti līdz 25-50 MB vienā sūtījumā). Ja video vai audio fails ir pārāk liels, tiesai tiek iesniegts pieteikums ar lūgumu atļaut pierādījumu iesniegt fiziskā datu nesējā (USB zibatmiņā) kancelejā.</p></li></ol><h2 data-path-to-node="24">4.
